Text-Messaging Contest official rules and regulations, no purchase necessary.

Nintendo of America Inc. ("Sponsor") whose address is 4820 150th Ave. N.E., Redmond, WA 98052 and is sponsoring the contest ("Contest").

Timing: Contest begins at 12:00:01 a.m. PDT on September 13, 2007 and ends at 11:59:59 p.m. on October 26, 2007 ("Contest Period"). Eligibility: Contest open to legal residents of the United States 18 years of age or older as of the date of entry. Void in Puerto Rico, the U.S. Virgin Islands, U.S. Military installations in foreign countries, anywhere outside of the U.S. and where prohibited, taxed or restricted by law. Employees of Nintendo of America Inc., and their family members, and each of their respective parent companies, subsidiaries, affiliates, and their advertising, contest and production agencies are not eligible to enter.

To Enter: You may enter the contest in either of two ways: By text messaging from your mobile phone or by mail. To enter by text messaging from your mobile phone, text "Zelda" to the following five digital code "20769" to opt in to receive three Legend of Zelda: Phantom Hourglass trivia questions. If you answer all three questions correctly, you will automatically be entered into the contest. Text messaging method of entry requires 2-way text messaging capable phone and digital service. You will be charged for the message that originated from your phone according to the terms in your calling plan with your carrier. Text messaging is not available in all areas in the U.S.

No purchase necessary to enter by mail. Simply hand print your name and address, including zip code, home and cell phone number, including area code, email address and date of birth on a postcard with the answers to the three trivia questions found on the contest landing page at http://zelda.com/ and mail it to: Legend of Zelda: Phantom Hourglass Contest, P.O. Box 71377, Los Angeles, CA 90071-9997. If you answer all three questions correctly, you will automatically be entered into the contest.

All winners are randomly selected by Sponsor. All text message entries must be received by 11:59:59 pm PDT on October 21, 2007 to be eligible. All mail-in entries must be postmarked by October 26, 2007 and received by Nov. 1, 2007. You may only enter once, regardless of method of entry. In case of dispute as to the identity of a text message entrant, entry will be declared made by the authorized account holder of the mobile telephone number. "Authorized Account Holder" is defined as the natural person who is assigned a mobile telephone number by the wireless carrier or as shown on the carrier's records.

Prize: First Prize:One (1) First Prize winner will receive a Nintendo World store closed-door holiday shopping spree for two (2) in New York City and airfare from an airport of Sponsor's choice within the U.S. to New York City ($1,500) ("Trip"), lodging at a hotel for two nights (double occupancy) of Sponsor's choice within the New York metro area ($1,000), a Nintendo World gift certificate ($1,000) and spending money ($500); one (1) Nintendo DS (special edition) video game system ($130); one (1) copy of Legend of Zelda: Phantom Hourglass ($40). Approximate Retail Value: $4,170.

Finalists: Nine (9) Finalists will receive one (1) Nintendo DS (special edition) video game system ($130) and one (1) copy of Legend of Zelda: Phantom Hourglass ($40). Approximate Retail Value: $170.

Odds of winning a prize depend on the number of eligible entries received. Many will enter; 10 will win. All prizes are awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose).

Arrangements for the fulfilment of all prizes will be made by Sponsor. Fulfilment of the prizes is tentatively scheduled to take place between November 1 and November 30, 2007, and is subject to change in Sponsor's sole discretion.

No substitution or transfer of the prizes or any portion thereof is permitted, except by the Sponsor, in which case a prize of equal or greater value may be awarded. The value of the prizes may be taxable to the winners as income. Upon receipt of a prize, winners are required to comply with any and all applicable federal, state and local laws, rules and regulations. Winners are solely responsible for any and all applicable federal, state and local taxes that become due with respect to their respective prizes. Any difference between the Approximate Retail Value and the actual value, if any, of any prize will not be awarded.

Conditions of Trip: Dates of travel are subject to availability. Winner's guest must be at least 18 years of age prior to winner's taking the Trip. Winner is responsible for ground transportation to and from the airports and hotel, all meals and all other expenses that winner or winner's guest incurs in connection with the Trip, including, but not limited to, all applicable passport, visa, and entry/exit fees.

General Conditions: The winner will be required to sign and return a notarized affidavit of eligibility and publicity/liability release that must be returned within seven (7) days of notification attempt or an alternate prize winner will be selected. Winner by acceptance of the prize agree to release the Sponsor, its parent companies, subsidiaries, affiliates, shareholders and its respective advertising, promotional and production agencies from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons and property which may be sustained in connection with participation in the contest, receipt, ownership or use or misuse of the prize or parts thereof or while preparing for, participating in and/or travelling to or from any prize related activity, and claims based on publicity rights, defamation or invasion of privacy. By participating, entrants agree to be bound by these official rules and the decisions of the Sponsor, whose decisions on all matters relating to this contest shall be final and entrants waive any right to claim ambiguity in this contest or these official rules. By accepting this prize, the winner grants to Sponsor the right to use the winners name, address and/or likeness for advertising and trade purposes without further compensation to or permission from the winner, unless prohibited by law. All entries become the property of the Sponsor and will not be returned or acknowledged. Neither the Sponsor, nor its parent, subsidiary or affiliate companies, nor its promotional agencies shall have any obligation or responsibility with regard to: (I) Entries that contain inaccurate information or do not comply with these rules, (II) Entries, prize claims or notifications that are lost, late, incomplete, illegible, unintelligible, damaged or otherwise not received by the intended recipient, in whole or in part, due to computer or technical error of any kind, (III) Telephone, electronic, hardware, software, network, internet or computer or communications malfunctions, failures or difficulties. The Sponsor in their sole discretion, reserve the right to disqualify any person tampering with the entry process or in the operation of the website or otherwise violating these rules. The Sponsor further reserve the right to cancel, terminate or modify this contest if this contest cannot be completed as planned because of infection by computer virus, bugs, tampering, unauthorised intervention or technical failures of any sort.

In the event that any dispute arises regarding the meaning or interpretation of these official rules, participants agree that the dispute will be resolved by applying the laws of the State of Washington and that is shall be resolved within and by the courts of that state. Contests are void where prohibited.

To obtain a copy of these rules, send a stamped, self-addressed business-size envelope to Sponsor at the address listed below, Attn: Legend of Zelda: Phantom Hourglass Contest Official Rules Request. Residents of VT may omit return postage.
